Simon, 150 Cal. 751 [89 Pac. 1077]; Willamette etc. Co. v. Colleye Co., 94 Cal. 229 [29 Pac. 629]; Stanton v. Superior Court, 202 Cal. 478 [261 Pac. 1001].) An appeal has been taken by all of the defendants except John G. Baker, on the ground that certain findings are not supported by the evidence.
